  1. You must create an account (Wallet) to use Hana Remit. When you create a Wallet, you will be asked to provide your personal information so that we can verify your identity for the purpose of complying with AML/CTF Laws (ID Verification). For this purpose, your personal information will be shared with AUDD Digital, and may be shared by AUDD Digital with third party identity verification services. You will only be issued a Hana Remit account if you pass the ID Verification process. We may also request additional information during this process.
  2. You acknowledge and agree that you are solely responsible for the security and retention of your Wallet details and it is your responsibility to keep your Details secure and confidential.

We may add or remove supported destination countries, currencies and payout methods (which may include bank transfer, e-wallet transfer, or cash pickup) at any time, and will notify you of any change before it takes effect.
  2. To send a remittance, you must provide us with accurate details of your Recipient, including their name and the account, e-wallet or pickup details to which the funds are to be sent. You must ensure you have your Recipient's consent to provide us with their information.
  3. Before you confirm a remittance, we will show you the amount you are sending, the exchange rate that applies, any fees payable, and the estimated amount your Recipient will receive (Remittance Details). Exchange rates are variable and may change between the time we show you the Remittance Details and the time we process your remittance.
  4. Once you confirm a remittance, we will act on your instructions to convert and transfer the corresponding amount to your Recipient using the payout method you have selected. You acknowledge and agree that:

    1. we reasonably believe it may involve fraud, money laundering, terrorism financing or any other illegal activity;

  2. You do not need any prior knowledge of blockchain technology or cryptocurrency to use Hana Remit, and unlike a self-custodied cryptocurrency wallet:

    1. you are not required to create, manage or keep safe any private key or seed phrase;
    2. your AUDC balance is held on your behalf via a virtual account established with AUDD Digital, rather than directly by you on the underlying blockchain; and
    3. when you deposit funds into your Wallet, withdraw funds from your Wallet, or send a remittance, the relevant amount of AUDC is created, redeemed or transferred on the underlying blockchain network by AUDD Digital to reflect that transaction.
  3. You acknowledge and agree that:

    1. our ability to provide the Services, including honouring deposits, withdrawals and remittances, depends on the availability, solvency and proper functioning of AUDD Digital and the underlying blockchain network; and
    2. to the maximum extent permitted by law, we are not liable for any Liability caused or contributed to by, arising from or in connection with any failure, insolvency, error or delay of the Stablecoin Issuer or the underlying blockchain network.

Transaction Fees

  1. There may be transaction fees associated with virtual currency and traditional currency transactions that are facilitated on Hana Remit. You are responsible for paying all transaction fees on Hana Remit. In the event that we pay any transaction fees on your behalf, you agree that you will repay us the transaction fees as a debt due and immediately payable. From time to time, we may be able to secure refunds of applicable virtual currency fees (i.e., network gas fees) for you by acquiring and/or disposing of a corresponding digital asset (i.e., a gas token). We provide this service in our sole discretion as an operational feature of Hana Remit, and do not acquire such digital assets using your funds, on your behalf or at your direction.

We may assign or transfer these Terms to a third party, or transfer any debt owed by you to us to a debt collector or other third party.
  2. Disputes: Neither we or you may commence court proceedings relating to any dispute, controversy or claim arising from, or in connection with, these Terms (including any question regarding its existence, validity or termination) (Dispute) unless we and you first meet (in good faith) to resolve the Dispute.
